Terms and Conditions: 

Memorandum of Incorporation of Off the Hoek Swim School. 

 

Notes: 

Off the Hoek Swim School is a privately-owned Swimming Pool which employs Qualified Aqua Instructors specialized in teaching the below mentioned Aquatic Activities. Aqua Instructors guide clients through a variety of exercises; through vocal instruction and physical demonstration; during a class of roughly 50 minutes. The Aqua Instructor takes into consideration the clients fitness level upon Registration and prepares the class accordingly. As the clients’ fitness level progresses, the Instructor will gradually increase the repetition and resistance of exercises performed, to challenge the client further. The instructors’ intention is to facilitate the client to strengthen and tone, both the cardiovascular system and the muscles of the body;  to motivate and encourage the client to enjoy and attend classes. Cardiovascular Exercise could include Jogging on the spot or across the pool, or other various arm and leg coordination’s to increase heart rate and physical exertion. Strength and Toning exercises could include the use of a pool noodle, kicking board, using different hand variations and/or aqua “weights” to increase resistance in the water, thereby targeting specific muscle groups. Clients enter into an agreement to receive Aqua Aerobic instruction from their current Fitness Level and progress to their Fitness Level of choice. It is headed by Shéa Skelton who is owner and who acts as director of the chosen projects in which Off the Hoek Swim School becomes involved with. The curriculum remains the intellectual property of Shéa Skelton, the Instructors and Off the Hoek Swim School and may under no circumstances be taught to any person or individual who does not have a written agreement with Off the Hoek Swim School. The contract between Off the Hoek Swim School and Client is legally binding. The contract between Off the Hoek Swim School and client is enforceable and the client will be liable for all cost necessary for their participation in the Aqua Aerobics Programme.

 

Aqua Fees: 

Client fees are paid 4 weeks in advance and must be paid before the 2ND of each month/ by the due date on the invoice/ any other date agreed upon by Off the Hoek Swim School and the client. 

Fees involve an annual registration fee and the agreed upon full amount in the client’s registration form. We do not take new clients on for the 2023/2024 season after 25 February 2024

Registration occurs annually at the start of the Swimming Season; or whenever the client begins lessons within that season.

Late fees: The client will be granted an extension period of one week, after which the client won’t be allowed to attend classes, when after this period the fees are still outstanding. 

Please Note: 

Fees for 5-9 December 2023 and 16 January – 3 February 2024 (4  weeks) are to be paid in full by the 2nd December 2023.

If the instructor cancel’s the class for any reason it will be rescheduled. Example: Personal Emergency, Illness, or if the pool temperature drops lower than 25 degrees. A message will be posted on the Whatsapp Group to confirm cancellation by 7am, the morning of the class. If the client cannot attend the rescheduled lesson due to illness, a doctor’s note must be provided, and Off the Hoek will credit the lesson for the following 4-week period. If the client does not use the credit in the next 4-week period, the credit will fall away.

If the client cannot attend a class, the instructor is to be informed at least one hour prior to class. If no students are in class 15 minutes after start time, class is to be cancelled. Classes will start at the arranged time, whether all clients are present or not. 

 

PLEASE NOTE CAREFULLY: Classes will not be rescheduled or reimbursed if you are absent, unless a Doctor’s note is provided. The monthly fee will be invoiced as usual.

Weather is unpredictable in this area, and should a class be cancelled or unattended due to such, the class will not be made-up or reimbursed. 

If a client does not wish to participate in Aqua Aerobics Classes any longer, the client must give 2 weeks’ written notice; otherwise, they will be liable for the fees involved. Please see below ‘Cancellation of Contract’ details.

PAID AQUA FEES ARE NOT REFUNDABLE. 

 

Aqua Aerobics Classes:

Off the Hoek Swim School is an independent Swim School and Company. The Aqua Aerobics Classes are based on the foundations of PAASA (The Professional Aquatic Association of South-Africa) or SAWFA (South-African Water Fitness Association). The Instructor oversees all class activities. If a client does not wish to take part in a single exercise, please let the Instructor know. Please inform the instructor, at the start of the class, of any current injuries or medical conditions she should be aware of.

 

October-March:  (2 classes per week)

Mondays and Wednesdays 8am-9am

Corien Monday

Sue-Jeanne Wednesday

Corien and Sue-Jeanne will fill in for each other should the need arise.

 

Aqua Aerobics Instructors:

Off the Hoek Swim school has under its employ the following Instructors for Season 2022/2023. 

 

Instructor Corien van de Merwe holds valid PAASA Certificates and a Current First Aid level 1 Certificate. Corien has taught for approximately 18 years since she received her qualifications in 1995.

 

Instructor Sue-Jeanne Jenkins holds a Current First Aid level 1 Certificate and has done several SAWFA update workshops since she started teaching in 2001. She has taught at Off the Hoek Swim School since 2014 to present.

Michelle works on the accounts and administration side and will create an Aqua Whatsapp Group to notify clients of any changes to lessons.

Example: For any personal inquiries regarding your account please contact Shéa directly; or if you have any other personal inquiries, please send directly to your instructor; and not on the group. We want to avoid disturbing other clients unnecessarily. Thank-you.

 

Classes begin at the above-mentioned times, please arrive 5 minutes early.

Please use the changing rooms provided to undress and dress.

Do not enter the Swimming Pool before the Instructor arrives.

Do not remove the pool cover and climb in.

Please note to go slowly on entering the swimming pool, the steps can be slippery.

Swim wear:

An appropriate Swimming Costume. A rash vest, wet suit top or lycra-leggings are helpful in cooler weather. Remember a Towel and a change of warm clothes for after class.

 

School Terms:

Swimming Season starts 9 October 2023 and ends 31 March 2024. 

Off the Hoek Swim School will be closed for school and public holidays. Please note: Aqua Aerobics classes will finish for 2023 on 9/12/23 and will begin on 16/01/24.

 

Cancelation of contract: 

2 week’s written notice must be given in cancelation of the contract. 2 weeks fees are to please be paid in full, regardless of client attending class or not. 

If fees were paid in full for the 2023/2024 season contract and/ or registration fees, the fees are not refundable when cancelling the contract. 

Notice must be given by 25 November 2023 if you will not be swimming in January 2024. 

No notice may be given from 26 November 2023 to 16 January 2024. 

This is a contract with 4-weekly instalments from October to March as described under ‘Fees’. 

If notice is given between 25 November 2023 and 16 January 2024, the client will still be liable for the full final instalment of December/January. 

A waiting period for re registration in the following season will also apply.

 

Alcoholic and illegal substances: 

No alcoholic and/or illegal substances are allowed on the premises. Any client, instructor or parent of student who fails to comply with this rule will be relieved of their contract immediately. Any suspicion of the use of alcohol and or illegal substances on the premises will be reported to the authorities immediately and will result in random drug testing on premises. This rule applies to clients (minors included), parents of students and any person on the premises involved with Off the Hoek Swim School.

 

Weather:

Swimming will continue as usual if it rains, or becomes cooler, and the water temperature remains at 27 degrees or higher. If there is lightening, clients will be asked to get out of the water.

 

Complaints: 

Complaints should follow any of the following procedures:

1. Written complaints: to be given to the instructor at the end of the class 

2. Verbal complaints: Meeting to be scheduled between director/ instructor and client. Clients and/or their husbands/partners, may by no means approach the instructor or any other client during teaching hours. These above-mentioned actions will lead to immediate termination of the contract where the client will still be liable for all the outstanding class fees until date of termination. 

 

Damages:

Property of Off the Hoek Swim School/Shea Skelton/Instructors: If any damages are caused by a client, husband, partner or relative of the client to any property of Off the Hoek Swim School/Shea Skelton/Instructors (changing rooms and communal areas or their contents, chairs, tables, mirrors, toilets, toilet paper, towels or cleaning materials etc.) the guardian will be held liable for the damages.

PLEASE DO NOT ATTEND CLASSES IF YOU ARE SICK OR IF YOU HAVE A CONTAGIOUS ILLNESS. We want to protect both yourself and our instructors from such, EG Sore throat, snotty noses, coughs, pink eye, diarrhoea, vomiting and so forth. Thank-you.

 

Indemnity:

  1. Off the Hoek Swim School/Shea Skelton/Instructors will not be held liable for any injuries during class or at other Aqua meeting venues. I understand Aqua Aerobics and Swimming is a hazardous activity to which injuries are common. 
  2. Off the Hoek Swim School/Shea Skelton/Instructors will not be held liable for any injuries or any other irregularities on the property or the property outside the Swimming Pool/School Gate. It is the clients’ responsibility to remain inside the gate or pool and take part in training. 
  3. If a client needs to be transported to any event by the Instructor or any other individual assigned by Off the Hoek Swim School/Shea Skelton/Instructors, they will not be held liable in the event of any accidents or irregularities. 
  4. Off the Hoek Swim School/Shea Skelton/Instructors will not be held liable or responsible for clients after class hours. If transport is late for unforeseen reasons, the Instructor will attempt to stay with the client if possible, but the Instructor is by no means responsible for above mentioned action and will not be held liable for any event that appears if she stayed or left. 
  5. Transport to and from classes are the responsibility of the client. Off the Hoek Swim School/Shea Skelton/Instructors will not be held liable for any miscommunication in connection with the means of transportation (taxi’s, carpools or motorcars) and the individual that takes responsibility for the clients’ safety before and after the Aqua Class. 
  6. Off the Hoek Swim School/Shea Skelton/Instructors will not be held liable to any accidents, losses, injuries, deaths, claims, damages and irregularities at any time of day (during, before and after class) on and outside the premises of Off the Hoek Swim School. 
  7. Off the Hoek Swim School/Shea Skelton/Instructors will not be held liable for any loss of client or relatives of clients’ property during, before or after class hours. 
  8. The participant hereby fully discharges Off the Hoek Swim School, its owners, employees and agents from any and all claims, demands, rights or action or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of the participant taking part in Off the Hoek Swim School activities, including, but not limited to any claims or personal injuries resulting from or arising out of the negligence of Off the Hoek Swim School, owners, employees or agents.

 I have read this Form and understand the content thereof as well as the risks associated with my participation in any activity.
